PAYMENT INFORMATION	NOTE: Final payment arrangements, including credit card transactions will be conducted over the telephone. The purpose of the information below is to answer any forseeable questions you may have concerning price and payment. We will, of course, contact you before starting your order. The cost of a three minute customized Telephone On-Hold Message is $339.00 plus shipping. ($25.00). If you need, we stock specialized (low cost) equipment sufficient to make playing Music & Messages On-Hold compatible with any telephone set-up, from large multi-line systems, to single, 2 line stand alone telephones. The cost of this equipment will depend upon the needs of your system or telephone set-up, but in most cases it will be $339.00. The cost of changing existing messages is $89.00 plus shipping, unless you're on a special plan for multiple changes (see Information, Prices & Procedure). Even though the music will be custom written specifically for your business, it will be considered a published work, and ownership of it will be held and maintained by Lexington Aire Music BMI. A $130,00 deposit is required upon acceptance of first time orders. Payment in-full is due and receivable upon completion, and prior to, shipment of product. Payment options are: VISA, MasterCard, American Express, Regular Check, Cashiers Check or Money Order. First time customers paying by regular check, please allow us up to five business days to process and/or verify your check before starting your order. CUSTOM MUSIC

Music is the key element in setting the tone of your on-hold message. For this reason (and this is what sets us apart), we custom write all music heard on your Lexington Aire on-hold message.

We understand that the type of music chosen for background portrays the TONE of your business. Generally, the music should be designed to put a caller at ease and support the message rather than dominating the on-hold listening experience. Remember, the idea is to utilize the on-hold message as one of your premier marketing tools. With this in mind help us determine the appropriate style of music suitable for your business.

KEY PHRASES

In a typical three minute on-hold loop, there are generally 6 to 8 short paragraph type statements, emphasizing between 4 to 6 distinguishable key points. For example, when put on-hold, you might hear the person in the message say: "Did you know that we stock large quantities of "X" in our local warehouse? This means that you can save as much as three days of shipping time on your next order. Please keep holding, someone will be with you momentarily." The key phrase of that statement would be: We stock large quantities of "X" in our local warehouse, saving customers as much as three days of shipping time.

AGREEMENT

Filling out and submitting this form DOES NOT obligate you to anything whatsoever. An order will NOT be considered confirmed and finalized until payment (i.e. deposit and/or payment in full) has been received by Lexington Aire.

Receipt of payment will put the content of this form, along with the following agreement into effect.

PLEASE READ THE FOLLOWING AGREEMENT, AS PAYMENT OF ANY TYPE RECEIVED FROM YOU (THE CUSTOMER) IN CONJUNTION WITH THIS FORM, WILL PUT INTO EFFECT EVERYTHING ON THE ABOVE FORM, ALONG WITH THIS AGREEMENT. LICENSING OF MUSIC: Customer will use music which has been written, and produced by Lexington Aire Music, BMI. Customer also agrees that said music will be used only with customers Lexington Aire produced -- Telephone On-Hold Music and Message product. REFUND AND TIME OF FINAL PAYMENT: The receipt of payment (as indicated above under PAYMENT INFORMATION) which will put this agreement into effect, will be refundable only if the above stated Telephone On-Hold product is NOT produced within a 30 day period of time following the date payment is received by Lexington Aire. Payment in-full of the remaining amount of the PRICE as stated above shall become due upon completion, and prior to delivery of said product. PAYMENT OF CHECKS: All checks must be payable to: LEXINGTON AIRE, P.O. Box 554 Huntsville, TX 77342. OWNERSHIP OF MUSIC: All Music used on Lexington Aire produced On-Hold Music & Messages, unless otherwise stated above (under ADDITIONAL INFORMATION), is music which has been written, produced, and published by Lexington Aire Music, BMI. Ownership of said music will be maintained by Lexington Aire Music BMI. Customer is granted a license to use said music for stated purpose only, unless it is specifically stated above that Customer wishes for Lexington Aire to produce said product using music which Customer claims to own, and that Customer will NOT hold Lexington Aire responsible or liable in any way, for any fees or penalties suffered by customer as a result of music copyright infringement. NON EXCLUSIVITY: It is expressly understood by customer that other businesses, even businesses of the same kind or type as customers may have the same, or similar sounding Music and / or messages, and that the customer does not have exclusive rights in this regard. FORCE MAJEURE: COMPANY shall not be liable for failure to produce if failure is caused by labor disputes, strikes, war, fire, flood, accident, mechanical or material shortages; or any act of God. In such case Lexington Aire may extend the time for completion of agreement or credit a pro rata amount to customer in its discretion.
